PLEASE READ THESE TERMS AND CONDITIONS OF PARTICIPATION IN THE DIOR BEAUTY PRIVÉ LOYALTY PROGRAM (“TERMS”) CAREFULLY. BY PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN. YOU ARE RESPONSIBLE FOR READING AND UNDERSTANDING THE TERMS, AND OTHER COMMUNICATIONS FROM US ABOUT THE PROGRAM IN ORDER TO UNDERSTAND YOUR RIGHTS, RESPONSIBILITIES, AND STATUS IN THE PROGRAM. BY ENROLLING IN THE PROGRAM, YOU ALSO AGREE TO BE BOUND BY THE PRIVACY POLICY FOUND ON PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THE TERMS OR OUR PRIVACY POLICY, DO NOT PARTICIPATE IN THIS PROGRAM.


1. Overview

1.1. The Dior Beauty Privé   Loyalty Program (“Program”) is offered at the sole discretion of PT L Beauty Brands (Parfums Christian Dior – Indonescia Office) (Business Identification Number - 9120300191317), with an address of Prudential Tower 12th Floor, Jl. Jend. Sudirman Kav. 79, Jakarta 12190(“Dior”, “we,” “our” or “us”).  


1.2. The Terms govern Dior’s relationship with members of the Program (collectively, “Members,” and individually, a “Member,” “you” or, “your”), including how Members manage their accounts, achieve Member status. The Terms supersede all previous terms and conditions applicable to the Program.


1.3. By joining the Program and becoming a Member, you agree that you have read, understood and agreed to be bound by the Terms and by any changes or modifications we may make in accordance with section 8 of the Terms. You should review the Terms and the related policies which available on Dior’s website frequently, to understand the terms and conditions that apply to the Program as they may change from time to time. Notwithstanding the above, in case of changes that are substantial and may cause significant adverse effect to you, we may notify you of such changes, where applicable, prior to the effective date.


2. Membership Eligibility

2.1. The Program is available to individuals for their personal use only and is limited to one account per individual and cannot be sold, lent, or assigned. Individuals who are legal residents of Indonesia and have reached the age of majority or are under the supervision of a parent or legal guardian who consents to the terms, are eligible to enroll as Members.


2.2. Corporations, associations, or other groups will not be allowed to participate in the Program. The Program will not be used for any business or commercial purpose, and we may refuse to create an account for any reason. 


3. Program Enrollment

3.1. Eligible individuals may enroll in the Program through one of the following options:


3.1.1. Visit Dior Beauty Boutique or Dior Beauty Counter listed on store locator (collectively, the “Store”), and proceed to complete the registration form. 

3.1.2. Visit our brand website, (“Brand Site”) and following the Program prompts to complete the registration form. 


3.2. You are required to provide at least your full name, date of birth, email, and mobile phone number in order to enroll the Program. You may update your personal information by logging in to your account and follow the instruction on the Brand Site, contacting us via the available channels provided in section 13, or by visiting any Store. Your account information is confidential and should not be shared with any other person.


4. Program Qualifications

4.1. The Program is a way in which we reward and thank our loyal   members for purchasing our products and for participating in certain brand experiences.  


4.2. For your purchase to qualify for the Program, you must be enrolled in the Program on the date of purchase and be signed into or have linked your account at the time of purchase. However, if your membership in the Program is terminated for any reason and you enroll in a new Program account, any purchases made prior to the date you enroll in a new Program account do not qualify for the Program.


4.3 Spendings accumulated during membership period i.e. twelve (12) months for all membership levels, from the date of your first qualifying purchase anytime shall affect the membership level that you are eligible for. At the end of the membership period, the spendings for the last 365 (three hundred sixty five) days will be accumulated to determine the new membership level.   


5. Membership Level

5.1. Only purchases made in Store and Brand Site are eligible for spending accumulation and/or visit frequency as required by us in the last period of 365 (three hundred sixty five) calendar days (“Eligible Spending”). In the event the purchases are returned or refunded, the spending accumulated for the membership level may be decreased or reversed. This may lead to a change in the membership level status due to either insufficient amount or visit frequency.



5.2. A Member moves up to the next membership level once he/she has accumulated enough Eligible Spending to obtain that membership level. There are four (4) membership levels as stated below:




6. Program Benefits and Rewards

6.1. Members enjoy Program’s benefits associated with their membership level. 


Reward offerings are subject to availability (and may be changed from time to time without prior notification to you) and must be redeemed at the Store, unless otherwise specified by us. These rewards are based on the spendings you have accumulated during the membership period. Other specific rewards vary based on availability. You must redeem your available rewards prior to the end of the membership period. 

6.2. Neither accounts nor Program rewards and/or benefits may be transferred, shared, or combined. Only the Member paying for the products may accumulate rewards and/or benefits. 


6.3. Rewards and benefits earned through the Program have no cash value, are non-transferable.

6.4. Rewards and benefit cannot be exchanged or returned for another product or service or a monetary refund.


6.5. The products and services available through the Program and any samples that we may provide to you are for personal use only. You may not sell or resell any of the products, services, or samples you receive from us. To the fully extent permitted by applicable laws, we reserve the right to cancel the products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Terms.


6.6. To the fully extent permitted by applicable laws, we are not responsible for rewards and/or benefits lost or redeemed due to fraudulent activity by you or any third party.


6.7. If you have concerns that a purchase or other activity was not properly applied to your account, you should contact us without unreasonable delay, but no later than thirty (30) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about purchases or other Program activities not being credited to an account.


7. Program-Related Communications. and Marketing Communications


7.1. The Member can access all information regarding his/her membership in the Program (including the operation of his/her account) via a beauty consultant at the Store. 


7.2. By agreeing this Terms and Conditions and becoming a Member of the Program, You acknowledge and agree  to receive any information and/or communication from us through any manner related with the Program (“Loyalty Program Communication Consent”). 


The Loyalty Program Communication Consent shall include, but not limited to program-related communications,   profile update confirmation, and other communications that relate to your membership account.    


Notwithstanding to the Loyalty Program Communication Consent, if you no longer wish to receive this information, which is deemed essential for Program operation, you must request to leave the Program. 


7.3. While enrolling in the Program, you may choose  to subscribe and consent to receive any Dior marketing communications (“Dior Marketing Consent”).


The Dior Marketing Consent include your consent to us in informing you,   including but not limited to services or promotional communications related to the Program,   such as new and seasonal launches, event invitations and service invitations which may encourage sales activities).    

   

Notwithstanding to the Dior Marketing Consent, you may unsubscribe and opt-out of receiving such marketing communications subsequently at any time by following the instructions provided in the marketing communications and as provided in our Privacy Policy. After your opting-out, your Program membership remains valid, but you can only receive program-related communications which still subject to clause 7.2 above.


8. Modification and Termination

8.1. The Program and its benefits are offered at our sole discretion. To the fullest extent permitted by the applicable laws, we may, in our discretion, cancel, modify, restrict or terminate the Terms and/or the Program or any aspect or feature of the Program at any time with or without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits. 


8.2. Any change will be effective immediately upon posting of such change on our Brand Site, or upon informing you via method of communication chosen at our sole discretion. Each changed version of the Terms and/or the Program or any aspect or feature of the Program shall apply and supersede all previous versions, including the hardcopy version (if any). Unless the Program is terminated, your continued participation in the Program, on or after the effective date for any change of the Terms and/or the Program or any aspect or feature of the Program, will be deemed as full knowledge and acceptance of such change. If you do not agree to any such change, your sole recourse shall be to cancel your membership.


8.3. Subject to the terms and conditions provided in this section, we reserve the right to exclude you from or to discontinue your participation in the Program and to audit your membership account at any time, in our sole discretion. Any suspected abuse of the Program, failure to follow the Terms, illegal activity, fraud, misrepresentation or other conduct inconsistent with the Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent other unauthorized use of any Program rewards, vouchers, coupon, may result in the revocation of your membership and make you ineligible for further participation in the Program. If your membership is revoked, rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of the Terms, we also have the right to take appropriate legal action, in our sole discretion.


8.4. If you decide you no longer want to be a part of the Program, you may cancel your membership by contacting us. If you cancel your membership, you will lose all rewards and benefits will automatically expire.


9. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold us, our officers, directors, employees, and agents harmless or any loss, damages or costs, including reasonable attorneys' fees, resulting from any third-party claim, action, or demand resulting from your participation in the Program in violation of any applicable laws, rules, regulations or the Terms. 


10. Governing Law and Disputes

This Program and the Terms will be governed by and construed in accordance with the laws of Republic of Indonesia, without regard to conflict of law principles, and any dispute arising out of or in connection with this Program and the Terms will be subject to and within the jurisdiction of the Indonesian courts.


11. Privacy

The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program membership, will be used and disclosed by us in accordance with the Dior Privacy Policy.


12. Entire Agreement, Waiver, and Survival 

12.1. The Terms contains the entire agreement of the parties regarding the subject matter of the Program and there are no other promises or conditions in any other agreement, oral or written regarding this subject matter. The Terms supersede any prior written or oral agreements between Dior and you regarding the subject matter of the Program. Unless expressly set forth otherwise, in the event of a conflict between the Terms and any other documentation exchanged between Dior and you, the Terms shall prevail.


12.2. The failure of Dior to enforce any provision of the Terms shall not be construed as a waiver or limitation of Dior’s right to subsequently enforce and compel strict compliance with every provision of the Terms. 


12.3. The following sections shall survive the cancellation or termination of the Program and your membership: 8, 9, 10 and 11. 


12.4. We reserve our rights to take any legal action against you if we discover that you have used your Account and/or membership fraudulently or maliciously or as a sham or part of a sham or using falsified information. You may also be liable for monetary losses to us, including any legal costs and fees.


12.5. If any provision of these Programs Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
